Agreement to these terms

This website is operated by MIYACA RUSTIC HORIZONS LLC ("Rustic", "we", "us" or "our"), a company located at 1590 Campana Court, Colton, CA 92324, United States. By using this website or placing an order, you agree to these Terms of Service and to the policies they reference, including our Shipping Policy, Returns & Refunds Policy and Privacy Policy. If you do not agree, please do not use the site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.

Products and descriptions

Our throws are handwoven from natural fiber. We describe and photograph them as accurately as we can, but colors can look different on different screens, and size, shade and pattern placement vary slightly from piece to piece. Dimensions are approximate. Some lifestyle images are styled renderings meant to show how a throw looks in a room. These natural variations are not defects.

Rustic is an authorized retailer of the products we sell. Product availability is not guaranteed, and we may limit quantities or discontinue items at any time.

Pricing and availability

All prices are in U.S. dollars. We work to keep prices and product information accurate, but errors occasionally happen. If we find a pricing or description error after you order, we will contact you and give you the option to continue at the correct price or cancel for a full refund. We reserve the right to change prices at any time before an order is accepted.

Orders and acceptance

Your order is an offer to buy. We accept it when we ship the item and send you a shipping confirmation. We may refuse or cancel any order, for example if an item is unavailable, if there is a pricing error, or if we suspect fraud or a violation of these terms. If we cancel after you have been charged, we will refund you in full.

Payment

Payment is due at checkout. Card payments are handled by our payment processor; we do not store your full card number on our servers. You agree to pay all charges at the prices in effect when you place your order, together with shipping and any applicable sales tax.

Shipping and risk of loss

We ship within the areas listed in our Shipping Policy. Delivery dates are estimates. Title and risk of loss pass to you when the order is delivered to the carrier, but we will still help you with lost or damaged packages as described in our Shipping Policy.

Returns and refunds

Returns, exchanges and refunds are governed by our Returns & Refunds Policy, which forms part of these terms.

Intellectual property

The Rustic name and logo, and the text, graphics, photographs and design of this website, are owned by or licensed to MIYACA RUSTIC HORIZONS LLC and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

Acceptable use

You agree not to misuse the site. That includes attempting to gain unauthorized access, interfering with its operation, using automated tools to scrape content or place orders, submitting false information, or using the site for any unlawful purpose. Orders placed for resale are not permitted without our written agreement.

Disclaimer of warranties

Except as expressly stated in our policies, and to the fullest extent permitted by law, the site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits any rights you have under applicable consumer protection law that cannot be waived.

Limitation of liability

To the fullest extent permitted by law, MIYACA RUSTIC HORIZONS LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Indemnification

You agree to indemnify and hold harmless MIYACA RUSTIC HORIZONS LLC from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these terms or your misuse of the site.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. If a dispute arises, please contact us first; most concerns can be resolved quickly. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in San Bernardino County, California, and you and we consent to their jurisdiction, except where applicable law gives you the right to bring a claim where you live.

Changes to these terms

We may update these terms from time to time. The "Last updated" date above shows when they last changed. The version in effect when you place an order applies to that order.
